Who This Is For

Non-EU Market Entrant AI Provider

Key Intelligence

The Netherlands has proposed AP (Data Protection Authority) and RDI (Human Environment and Transport Inspectorate) as coordinating MSAs, with AP receiving additional budget for AI Act enforcement — but formal authority appointments remain pending as of April 2026

The Dutch government published a comprehensive AI Act Guide in September 2025 — one of the most extensive official compliance guidance documents produced by any EU member state, covering obligations across provider, deployer, and importer roles

The Netherlands hosts ASML, Philips, ING, and a dense concentration of AI-intensive multinationals whose systems span high-risk categories in semiconductor manufacturing, medical diagnostics, and financial services

The AP has a strong GDPR enforcement track record and has already investigated algorithmic decision-making systems — its extension into AI Act supervision will create a unified data and algorithm enforcement authority with significant cross-sector reach

The Dutch startup ecosystem — including 500+ AI companies in Amsterdam, Eindhoven, and Delft — is highly export-oriented and disproportionately exposed to GPAI and high-risk AI obligations relative to its size

Supervisory Authority

AP / RDI ↗

Status: Pending Designation

Notes: On 20 April 2026, the Netherlands published a draft Implementation Act (Uitvoeringswet AI-verordening) for public consultation, marking a major step forward. The Dutch Data Protection Authority (AP) and the State Inspectorate for Digital Infrastructure (RDI) are designated as the two coordinating authorities. The RDI acts as the national SPOC under Article 70. The AP will be the lead MSA for prohibited practices, transparency obligations, and the majority of high-risk AI systems under Annex III (including biometrics, education, employment, lending and government AI). A minimum of 10 market surveillance authorities are specified. The AP and RDI jointly operate a mandatory AI regulatory sandbox. Full law expected Q4 2026 after consultation.
