Notes: Malta's dual-authority model confirmed under two Legal Notices published October 2025: L.N. 226/2025 (amending MDIA Act) designates MDIA as primary MSA, SPOC, and notifying authority; L.N. 227/2025 (amending Data Protection Act) confers supervisory powers on IDPC (Information and Data Protection Commissioner) for high-risk AI systems and certain prohibited AI practices. MDIA is specifically mandated to establish and operate Malta's national AI regulatory sandbox — to be operational by 2 August 2026. IDPC maintains a registry of high-risk AI systems and may impose administrative penalties, warnings, and corrective measures. Maximum administrative penalty: €350,000 per infringement.
