Key Intelligence

Hungary enacted Act LXXV of 2025 in December 2025, designating the Minister for National Economy as MSA and the National Accreditation Authority as notifying authority — one of the few Central European states with enacted implementation legislation

Hungary's implementation model is unusually centralised — placing AI Act oversight under a ministry rather than an independent regulatory agency raises questions about institutional independence that the European Commission may scrutinise

Budapest's growing tech ecosystem, including significant automotive AI (Audi, BMW, Mercedes production facilities with embedded AI), financial services AI, and a developing startup scene, creates real Annex III exposure particularly in industrial and financial AI

Hungary's formal EC notification of its designated authorities had not been confirmed as of April 2026, creating a gap between enacted law and operational enforcement architecture

The combination of enacted legislation and an unconfirmed EC notification makes Hungary's compliance environment more legally certain than non-legislating peers but less operationally settled than jurisdictions with confirmed authority structures

Status: Pending Designation

Notes: Act LXXV of 2025, adopted to implement the EU AI Regulation, entered into force on 1 December 2025. The Act empowers the government to designate MSA and notifying authority by decree. In practice, the NMHH (National Media and Infocommunications Authority) is referenced in business guidance as the oversight body; however, the old notes referencing "Minister for National Economy" should be noted as potentially superseded by government decree — formal confirmation of the exact MSA pending as of May 2026. Section 3(2) and Section 10 of the Act take effect on 2 August 2026. The Hungarian Artificial Intelligence Council has been created for strategic guidance and cross-government coordination. AI regulatory test environment provisions are included in the law. Financial sector AI supervised by the central bank under Article 74(6). Formal EC notification of SPOC has not been confirmed.
