Key Intelligence

Belgium has designated fundamental rights authorities under Article 77 but has not yet formally designated MSAs or published a national implementation bill — BIPT is expected as lead authority but no formal appointment has been made as of April 2026

Belgium's strategic importance exceeds its size — as home to the EU institutions, NATO headquarters, and a dense concentration of European affairs professionals, Brussels is where AI Act policy is being shaped, and Belgian compliance decisions will be scrutinised by the entire European regulatory community

With 25% enterprise AI adoption and 744 AI startups, Belgium has one of the highest AI intensity ratios relative to GDP in the EU — creating a large and compliance-ready addressable market despite incomplete institutional infrastructure

The FPS Economy has published an AI Act information webpage, signalling administrative awareness, but the absence of a draft implementation bill makes Belgium one of the most institutionally lagging Western European states relative to its AI market maturity

Belgium's multilingual economy — French, Dutch, and German-speaking regions with different administrative traditions — creates additional coordination complexity for a national AI Act implementation that must work across three distinct regulatory cultures

Supervisory Authority

BIPT (expected) ↗

Status: Awaiting Designation

Notes: BIPT (Belgian Institute for Postal Services and Telecommunications) confirmed as primary market surveillance authority under the Government Declaration of 31 January 2025. However, formal MSA and notifying authority designation procedures are not yet complete as of May 2026; no formal EC notification submitted. APD/GBA (Belgian DPA) is active on AI and data guidance. Belgium has a complex federal structure requiring coordination between federal (BIPT, APD/GBA) and regional authorities. No draft AI implementation bill has been introduced to Parliament. Belgium has one of the highest AI adoption rates in the EU (~25% of enterprises, ~744 AI startups). Fundamental rights authorities designated. The Spring 2026 DLA Piper Brussels IP and Tech Update noted no significant new Belgian AI Act legislative developments.
